Terms of Service

1. Purpose

These Terms of Service (hereinafter "ToS") define the terms and conditions of use of the tukio.one platform (hereinafter "the Platform"), as well as the rights and obligations of the parties.

2. Definitions

• Platform : the tukio.one website and all associated services.
• Client : any individual or legal entity using the Platform to search for and book event services.
• Provider : any professional offering event services on the Platform.
• User : any Client or Provider registered on the Platform.
• Booking : the contractual agreement between a Client and a Provider for a service.

3. Registration

Registration on the Platform is free and open to any adult individual or legal entity. The User agrees to provide accurate and up-to-date information. They are responsible for the confidentiality of their login credentials.

4. Description of services

The Platform connects Clients with event service Providers. It offers search, online booking, secure payment, messaging and review management services. tukio.one acts as an intermediary and is not party to contracts between Clients and Providers.

5. Booking and contract

Booking a service constitutes a contractual commitment between the Client and the Provider. The Client agrees to pay the agreed price and the Provider agrees to deliver the service as described. The Platform reserves the right to cancel any booking in case of breach of these ToS.

6. Pricing and payments

Service prices are freely set by Providers and displayed including taxes. Payment is made online via Stripe. The Platform charges a commission on each transaction, the rate of which varies according to the Provider's subscription plan. Funds are held in escrow until the service is delivered.

7. Client obligations

The Client agrees to use the Platform fairly and in accordance with its purpose. They agree to provide accurate information, honour booking commitments, not publish unlawful or defamatory content, and respect intellectual property rights.

8. Provider obligations

The Provider agrees to hold all necessary authorisations and insurance for their activity. They agree to provide accurate descriptions of their services, maintain their availability, honour confirmed bookings and maintain a quality level consistent with reasonable Client expectations.

9. Intellectual property

All elements of the Platform (texts, images, logos, software) are protected by intellectual property law. Any unauthorised reproduction, representation or exploitation is strictly prohibited. Content published by Users remains their property, but they grant tukio.one a non-exclusive licence to use it for the operation of the Platform.

10. Limitation of liability

tukio.one acts as an intermediary and shall not be held liable for the quality of services provided by Providers, nor for direct or indirect damages resulting from the use of the Platform. The liability of tukio.one is limited to the amount of commissions collected on the transaction in question.

11. Personal data

The processing of personal data is governed by our Privacy Policy. By using the Platform, you consent to the processing of your data in accordance with this policy and the General Data Protection Regulation (GDPR).

12. Modification of ToS

tukio.one reserves the right to modify these ToS at any time. Users will be informed of any modification by email or notification on the Platform. Continued use of the Platform after modification constitutes acceptance of the new ToS.

13. Applicable law and jurisdiction

These ToS are governed by French law. In case of dispute, the parties shall endeavour to find an amicable solution. Failing that, the courts of Paris shall have sole jurisdiction.

14. General provisions

If any provision of these ToS is declared null or unenforceable, the other provisions shall remain in force. The failure of tukio.one to exercise a right provided for in these ToS shall not constitute a waiver of that right.
